A Decatur County man was convicted this week of aggravated assault on a 6 month old infant after doctors diagnosed the child with symptoms consistent with Shaken Baby Syndrome.
The assault occurred in June 2015 (read the original story here) and was tried in the Superior Court of Decatur County under Judge Heather Lanier. This was the first trial in Decatur County for Judge Lanier, who replaced longtime Superior Court Judge A. Wallace Cato, who retired at the end of 2016.
According to District Attorney Joe Mulholland, the child was left with his father, DeMarco Murphy for the weekend. It was during this time that the child was injured.
Murphy was charged and convicted of aggravated assault. He was also charged with cruelty to a child in the first degree, but acquitted. At sentencing, Murphy could face up to 20 years in prison.
